|Alternative Abstract||Through carefully examining all the corporeal and incorporeal aspects of the faculty of human soul and putting them into practice in light of the ultimate objectives of the Islamic Sharia (i.e. Maqasid Al-Shariah), this study aims to highlight the greatness and dignity of the human soul. Besides, it attempts to review the protective measures taken by the government and society of Qatar to activate caring and protection of this faculty in question .
The importance of this study stems from the fact that it examines the greatest ultimate objective of the Islamic Sharia, that is, the faculty of human soul from a Maqasidi perspective. Besides, it reviews the methodologies adopted by the Qatari society in caring about human soul and in putting all customs and traditions that secure its safety into practice .
The most important question offered by this study yet mainly revolves around how this Objective along with its relevant contemporary applications is activated in Qatar .
As far as the outline of the study is concerned, it consists of an introduction and three (3) Chapters. As for the introduction, it is an overview on Maqasid Al-Sharia along with its faculties, divisions and arrangements. As for Chapter One, it casts light on the Shari theorization of caring about the faculty of human soul, whereas Chapter Two highlights the activation of caring about the faculty in question along with its contemporary application in the Qatari society. As far as Chapter Three – the last chapter – is concerned, it highlights the activation of the behaviors and customs influencing caring about this faculty and its applications as to the useful/harmful customs as well as the protective measures taken by both the State and the society to protect one’s soul .
The study arrives at a number of findings including: (1) the Objective of protecting the human soul is laid down in the Islamic Sharia through a system of values and laws recorded in and extracted from the texts of the Quran and the Sunnah; (2) Islam has actually legislated the best way to protect human soul and to prevent committing any aggression against it, a point which is proved by the fact that it calls for adopting all the means whereby the soul could be protected; and (3) the State of Qatar has laid down a wide variety of legislation and laws necessary for caring about and protecting this faculty in question based on the rulings of the Islamic Sharia .
Based on the findings of the study, I submitted a number of recommendations stressing the necessity that the State should lay down more laws and legislation on protecting and caring about human soul and that competent authorities should hold conferences and symposia to showcase how the Islamic Sharia cared about this faculty and the protection of the human rights even before the emergence of the imperfect man-made laws, and to increase the society’s awareness of the importance of promoting the soul and keeping it from all what might harm it.
