| Abstract | يدور جوهر هذا البحث حول فعالية دور مفتش العمل في قانون العمل القطري في تحقيقه لهدفه الرئيسي في تنفيذ أحكام قانون العمل والقرارات المنفذة له، ومراقبة تطبيق التشريعات العمالية المتعلقة بحماية العمال وأصحاب العمل على حد سواء، وذلك من خلال البحث في مدى كفاية النصوص القانونية الراهنة التي تحدد ألية عمل جهاز التفتيش وسلطات وصلاحيات المفتشين – في دولة قطر – في التصدي للإشكاليات والصعوبات المعاصرة التي تكتنف أو تعترض عملية التفتيش، لمعرفة سبل مواجهة التحديات التي تواجه مفتشي العمل وجهاز التفتيش في مجملة. فضلاً عن مدي التطبيق الصحيح لأحكام قانون العمل القطري رقم (14) لسنة 2004م والقرار الوزاري رقم (13) لسنة 2005م. وقد قسمت هذه الدراسة إلى فصلين أساسيين، ، نتناول في الفصل الأول من هذه الدراسة : نطاق واسع لتدخل مفتشي العمل ، وذلك من خلال بحث المجال المتسع لتفتيش العمل من حيث الزمن ، ومن حيث الموضوع ، أو( الدور الرقابي لحسن تطبيق مقتضيات القانون والعقد) ، على أن يسبق ذلك بحث أنواع تفتيش العمل. بينما خصصنا الفصل الثاني لدراسة الصلاحيات المتنوعة لمفتشي العمل ، وذلك من خلال بحث صلاحيات المفتش في حالة وجود المخالفة (مبحث أول) ، ثم بحث صلاحيات المفتش في حالة غياب المخالفة (مبحث ثان). |

In addition to the correct application of the provisions of the Qatari Labor Law No. (14) of 2004 AD and Ministerial Resolution No. (13) of 2005. This study was divided into two main chapters. In the first chapter of this study, we discuss: a wide scope for the intervention of labor inspectors, by examining the wide field of labor inspection in terms of time and subject matter, or (the supervisory role for the proper application of the requirements of the law and the contract), This should be preceded by an examination of the types of labor inspection. While we devoted the second chapter to studying the various powers of labor inspectors, by examining the powers of the inspector in the event of a violation (first topic), then examining the powers of the inspector in the absence of a violation (second topic). |
