| Abstract | يتناول البحث عقد البيع الدولي للبضائع الذي تنظمه اتفاقية الأمم المتحدة بشأن عقود البيع الدولي للبضائع 1980 اتفاقية فيينا، ويبين مفهومه، ومعيار دوليته، وكذلك البيوع والمسائل العقدية التي تستبعدها اتفاقية فيينا من نطاق تطبيقها. أهداف البحث بالنظر إلى الدور الذي تلعبه دولة قطر في التجارة الخارجية؛ كونها تصدر البترول والغاز الطبيعي، وتستورد العديد من السلع والبضائع، يسعى البحث إلى إظهار أهمية انضمام دولة قطر إلى اتفاقية فيينا التي يمكن أن تحكم عقود البيع الدولية التي يكون لواحد من أطرافها مكان عمل في دولة قطر. المنهج يتبنى البحث المنهج الوصفي التحليلي من أجل إظهار الجوانب السلبية (والإيجابية) لتحديد القانون الواجب التطبيق على عقد البيع الدولي للبضائع وفقا لقاعدة الإسناد الواردة في المادة 27 من القانون المدني القطري، وكذلك النتائج الإيجابية التي سوف تترتب على انضمام دولة قطر إلى اتفاقية فيينا. نتائج البحث توصل البحث إلى أن انضمام دولة قطر إلى اتفاقية فيينا سوف يؤدي إلى توفير قانون موحد لحكم عقود البيع الدولي للبضائع، الأمر الذي يعزز التجارة الخارجية ويشجع على الاستثمار الأجنبي في دولة قطر. أصالة البحث: يتمتع البحث بقيمة علمية عالية كونه يناقش مسألة أصيلة وغاية في الأهمية. وبعد أن أظهر البحث الفائدة العظيمة من انضمام دولة قطر إلى اتفاقية فيينا، أظهر أيضا أن اتفاقية فيينا يمكنها التعايش ببساطة مع النظام القانوني في دولة قطر، ودون التضارب مع النظام العام فيها. كما أن بعض الحقوق الجديدة التي تقرها اتفاقية فيينا كالفسخ للإخلال الجوهري فقط، والفسخ أو وقف تنفيذ الالتزام للإخلال المبتسر، أو منح المهلة الإضافية للتنفيذ)، يمكن أن يكون فرصة للإصلاح في القوانين القطرية. للاقتباس: |

| Alternative Abstract | The paper tackles the sale contract regulated by the 1980 UN Convention on Contracts for the International Sale of Goods (CISG), in terms of its concept, internationality, sales and contractual issues that CISG excludes from its scope of application. Objectives: Given the role played by Qatar in foreign trade, as it exports oil and natural gas and imports many commodities and goods, the paper. seeks to show the importance of the Qatar's accession to CISG, which may govern international sales in which one of the parties has a place of business in Qatar Methodology: The paper adopts the descriptive, analytical approach to show the disadvantages of determining the law applicable to the sale of goods contract in accordance with the conflict-of-laws rule stipulated by Article 27 of the Qatari Civil Code. The paper also shows the positive results that would realize with the accession of Qatar to CISG. Results: The paper concludes that the accession by Qatar to CISG will make contracts for the international sale of goods subject to a uniform law. This, in turn, would enhance foreign trade and encourage foreign investment in Qatar. Originality: The paper has a high scientific value as it discusses an original and important issue. After the paper shows the great benefit of Qatar's accession to CISG, it also shows that CISG will simply coexist with the legal system in Qatar, without conflict with public order. Also, some of the new remedies recognized by CISG (such as requirement of fundamental breach for avoidance, avoidance or suspension of performance of the obligation for anticipatory breach, or allowance of additional time for performance) could be an opportunity for reform in Qatari laws. |
