Abstract	يتناول هذا البحث أثر الاحتجاج بمفهوم المخالفة في التفسير للنصوص القانونية، والتطبيق في الأحكام القضائية، محاولاً في ذلك ربط حجية هذا المفهوم عند الأصوليين بالشروط التي ذكروها للعمل به، وأثر تلك الحجية عند رجال القانون، وذلك من خلال إعمال مفهوم المخالفة كطريق من طرق التفسير القانوني، باستثمار دلالته في النصوص التشريعية، ومدى اعتبارها في التطبيقات في الأحكام القضائية، وقد ألح الباحث على إثبات دعوى أخذ رجال القانون بدلالة المفهومء وذلك عن طريق مقارنة منهج القانونيين بمنهج الأصوليين، مع توضيح آثار هذا الأخذ لمفهوم المخالفة في النصوص التشريعية في القانون الكويتي، والتطبيقات القضائية لأحكام القضاء الكويتي، للوصول إلى أن القانونيين، والمشرع الكويتي والأحكام القضائية الكويتية، قد أخذوا بمفهوم المخالفة في التفسير القانوني والتطبيق القضائي، واعتبروه أحد طرق التفسير القانوني، وذلك تبعاً لاتفاق الأصوليين في الأخذ بمفهوم المخالفة في غير النصوص الشرعية. وقد استخدم الباحث المنهج الوصفي التحليلي وذلك من خلال تحليل الخلاف الأصولي والقانونيء والمقارنة بينهماء وأثر ذلك في التطبيق في تفسير النصوص القانونية في التشريع الكويتيء والأحكام القضائية الكويتية.

Alternative Abstract	This research deals with the effect of invoking the concept of contravention in the interpretation of legal texts, and its application in judicial rulings, trying to link the argument of this concept for fundamentalists with the conditions they mentioned, and its effect on the lawmen through applying the concept of contravention as a way of legal interpretation, investing its significance in judicial texts, considering it in the applications of the judicial rulings. The researcher insisted on proving the claim of taking the jurists in the meaning of this concept, by comparing the legalists approach, with the Scholars of Usul al Fiqh approach, and with the clarification of the effects of applying the concept of contravention on the Common Texts of the Kuwaiti law and the judicial applications, in order to reach that Kuwaiti legalists legislators, and judicial rulings applied the concept of contravention in the legal interpretation and Judicial application in accordance with the agreement of the fundamentalists in taking this concept even for the illegal texts. The researcher used the descriptive and analytical method through analyzing the legal and fundamental contravention and comparing between them, and what is the effect on the application of the legal texts interpretation In Kuwaiti legislation and Kuwaiti judicial rulings.
